Article 1. Introduction

  1. This "Privacy Policy" ("Privacy Policy") sets out the ways in which PokéPark KANTO LLC ("Company" or "we"), collects and uses personal information and data ("Personal Information") regarding customers ("Customer" or "you") of ①the "PokéPark Official Website" ("Site") governed by the "PokéPark KANTO Official Website Terms of Use" ("Terms"), ②the "Official PokéPark KANTO App" ("Application") governed by the "Official PokéPark KANTO App Terms and Conditions" ("T&C") and ③ the "PokéPark KANTO" ("Park") governed by the "PokéPark KANTO Rules and Regulations" ("Rules")
  2. It also explains what rights the Customer have to access or change Personal Information.
  3. The Privacy Policy sets out the collection and use of Personal Information as stipulated in the Terms, the T&C, and the Rules. The Terms, the T&C, the Rules and the Privacy Policy are governed by and shall be interpreted in accordance with the laws of Japan.
  4. The Privacy Policy is prepared under applicable laws to inform you that your Personal Information may be processed by the Company.

Article 4. Changes to the Privacy Policy and your duty to inform the Company of changes

The Company may amend the Privacy Policy at any time by changing the last updated date. If the Company makes material changes to how the Company collect, use, or share your Personal Information, the Company will describe the changes, and, if required by law, notify you and/or seek your consent for such changes.
It is important that the Personal Information the Company hold about you is accurate and current. Please keep the Company informed if your Personal Information changes during your relationship with the Company by updating or contacting the Company via the contact details in Article 2.

Article 5. Information the Company collects about you

  1. Information that you provide to the Company
    The Company does not require Personal Information to use the Site. If you choose not to disclose Personal Information, however, you will not be able to enjoy certain features of the Site.
    The Company will collect any information that you provide to the Company when you:
    1. Access certain features or functions in the Site that require Personal Information;
    2. Make an inquiry, provide feedback, or make a complaint via email or the Company's support site; or
    3. Submit correspondence to the Company via post, email, or the Company's support site.
  2. Information the Company collect about the Customer
    1. Information contained in correspondence
      The Company will collect any information contained in any correspondence between you and the Company. For example, if you contact the Company for customer support, the Company may keep a record of the correspondence;
    2. Technical data
      The Company will also collect certain information about how the Customer use the Site and the browser and/or device that the Customer use to access the Site. This might include device information (such as your hardware model, operating system information, unique device identifiers, terminal identifier, advertisement identifier, terminal information, terminal setting information, et cetera), the data transmitted by your browser (such as your IP address, time zone settings, access status / HTTP status code, language settings, and time zone settings referral source), information about your interactions with the Site, including time- and date-stamped information such as page views, requests, number of sessions, length of visit to the Site, keystrokes, and similar information. The information may be collected by a third-party analytics service provider on the Company's behalf and/or may be collected using cookies or similar technologies. Article 6. How the Company use information about and received from the Customer

  1. The Company will use your information for the purposes listed below either on the basis of:
    1. Performance of your contract with the Company and the provision of the Company's products or services to you;
    2. Your consent (where the Company request it);
    3. The Company's need to comply with a legal or regulatory obligation; or
    4. The Company's legitimate interests.
  2. The Company uses your information on the basis of the above and for the Company's legitimate business objectives, including for the following purposes:
    1. To provide access to the Site;
    2. To allow you to access certain features of the Site;
    3. To process and facilitate transactions between the Company and you;
    4. Customer support. To provide customer service and support, deal with inquiries or complaints about the Site, and to share Personal Information with the Site's developers, IT support provider, and other services providers as necessary to provide customer support;
    5. Analysis. To use data analytics to improve the Site, products/services, marketing, customer relationships, and experiences;
    6. Fraud and unlawful activity detection and prevention. To enable the Company to comply with the Company's policies and procedures and to enforce the Company's legal rights, or to share your information with the Company's technical and legal advisors, and to comply with laws or respond to lawful requests and legal process, including, for example, complying with a court order or subpoena.

Article 7. Who the Company might share your information with

In connection with the purposes and grounds described above, the Company will share Personal Information when relevant with third parties, such as:
  1. The Company's service providers.
    Third-party vendors such as customer support companies (Side International Japan Co., Ltd. based in Japan), consultants, and other service providers who work for the Company to support the internal operation of the Site and related services and who access your Personal Information to do that work;
  2. Joint investor of the Company.
    The Pokémon Company, YOMIURI LAND CO.,LTD and The Yomiuri Shimbun, Tokyo Headquarters based in Japan;
  3. Prospective sellers and buyers of the Company's business.
    In connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of the Company's business or assets;
  4. Other third parties (including professional advisers).
    Any other third parties (including legal or other advisors, regulatory authorities, courts, law enforcement agencies and government agencies) based in the UK, USA, Japan, and other countries/regions to enable the Company to enforce the Company's legal rights, or to protect the rights, property, or safety of the Company's employees, or where such disclosure may be permitted or required by law.

Article 8. Cookies and similar technologies

  1. The Company, and others, use cookies, web beacons, device IDs, and similar technologies to ensure that you get the most out of the Site. Cookies are small amounts of information in the form of text files which the Company stores on the device you use to access the Site. Cookies and similar technologies, such as device IDs, allow the Company, and others, to understand your and other users' use of the Site, provide functions on the Site, and support and improve operations of the Site.
  2. Except where strictly necessary to provide the Site, you may refuse cookies, web beacons, device IDs, and similar technologies.
  3. The Site may contain content and links to other sites that are operated by third parties that may also operate cookies and other tracking mechanisms. The Company does not control these third-party sites or their tracking activities, and the Privacy Policy does not apply to them. Article 9. How the Company looks after and retains the Personal Information

  1. The Company will use technological and operational security measures intended to protect the Personal Information against unauthorized access or unlawful use. However, please understand that no security measures is perfect or impenetrable.
  2. The Company will retain your information for as long as is appropriate to provide you with the services that you have requested from the Company or for as long as the Company reasonably requires for the Company's lawful business purposes, such as for legal compliance and enforcement purposes, and for resolving disputes. Actual retention periods depend on a variety of factors such as the type of product, the type and sensitivity of the information, business needs, the types of available user controls, and the form in which the information is stored.
  3. The Company will delete your information when it is no longer needed to be retained in light of the purpose of use. If applicable, your information printed out in sheets shall be shredded by paper shredders or destroyed by way of incineration, and your information saved in electronic file formats shall be deleted with the use of technical methods in which records cannot be restored.

Article 10. Location of processing and storage the Personal Information

  1. The Company is located in Japan, and the Personal Information that the Company collects from you will predominantly be processed and stored in Japan

Article 11. What types of information does the Company collect about children?

The Customer to the Site, including children, can use the Site, view content, and enjoy all features with only minimal Personal Information collected, such as technical identifiers used for the support of the internal operations of the Site. In addition, if parental or guardian consent is legally required, Company will ask for parental or guardian consent.

Article 12. Third-party links

The Site may include links to third-party websites, plug-ins, and apps. Clicking on those links or enabling those connections may allow third parties to collect or share information and data about you. The Company does not control these third-party websites, plug-ins, and apps and is not responsible for their privacy statements. When you leave the Site, the Company encourages you to read the privacy policy of every third party you visit.

Article 13 Acquisition of Personal Information

The Company may acquire Personal Information as set forth below, by way of directly receiving the same from the Customer, or indirectly receiving the provision thereof from a third party:
  1. The Customer's contact information
    In the case of the Customer using the Application and Park the Company may acquire the Customer's contact information including your name, date of birth, address, telephone number, email address, or other information provided by the Customer, etc.
  2. Information regarding the Customer's purchase and payment of tickets
    In the case of the Customer using the Application and Park the Company may acquire information regarding tickets, including the type, number, entry date, etc., of the tickets purchased by the Customer. In addition, in the case of the Customer using the Park, the Company may acquire information regarding the Customer's payments, including credit card number, payment amount, payment method, payment date, etc.
  3. Information regarding photographs and videos taken within the Park
    Within the Park, for the purpose of preventing crime and securing the safety of the Customer, the Company has installed monitoring camaras. In the case of the Customer using the Park, the Company may take and obtain photographs and videos of the Customer.
  4. Information contained in the communications provided to the contact desk
    In the case of the Customer using the Application and Park if the Customer contacts to the Company, the Company's contact desk, or any of the staff in the Park, the Company may acquire the information provided by the Customer which is contained in the contents of the Customer's communications.
  5. Sensitive personal information regarding the Customer
    In the case of the Customer using the Park, the Company may acquire information regarding the Customer's physical, mental or other disabilities. In addition, in the case of the Customer using the Park, the Company may request the Customer to present documents relating to any disabilities. In acquiring the information, the Company shall obtain consent from the Customer unless otherwise set forth in the laws, regulations, etc., and shall promptly delete the information after the purposes of use thereof have been achieved.

Article 14. Purposes of use

Unless otherwise permitted under the laws or regulations, the Company may use the Personal Information obtained from the Customer for the following purposes:
  1. Providing the Customer with the Application and Park:
    1. Providing or informing the Customer of the Application and Park and other products or services related or incidental thereto;
    2. Paying the consideration for providing the Application and Park and other products or services related or incidental thereto;
    3. Providing the Customer with support, including responding to inquiries regarding the Application and Park; or
    4. Confirming the Customer's identity as required to provide the Application and Park.
  2. Safely operating the Application and Park:
    1. Detecting and preventing fraud and illegal acts, and conducting legal compliance, including responding to inquiries in accordance with the laws and regulations;
    2. Contacting the Customer who it is necessary to make contact with for the operation of the Application and Park or taking emergency care, etc., of the Customer at the Park;
    3. Ensuring safety for the Customer and any of the staff in the Park, and providing safety management of the facilities and equipment in the Park; or
    4. Improving the Application and Park and other products or services related or incidental thereto; or developing and examining new products and services (including preparing statistical data therefor).
  3. Conducting public relation activities, etc., for the Application and Park.
    1. Conducting public relations activities, advertising and promotion activities, and marketing activities, and preparing statistical data for such activities; or
    2. Providing information and distribution for the products, services, events, campaigns, etc., of the Park or the Company based on the Customer's hobbies and/or preferences.

Article 15. Disclosure and Provision to Third Parties

The Company shall not disclose or provide any Personal Information to any third parties, except in the following cases:
  1. If any of the provisions in the Article 16 below "Joint Use of Personal Information" apply;
  2. If disclosing or providing the Personal Information to a business contractor, including the company providing customer support such as responding to inquiries (Side International Japan K.K.), etc., to the extent necessary for achieving the purposes of use as stated in the Privacy Policy (in such case, the Company shall provide necessary and appropriate supervision over such business contractor, including entering into an agreement regarding the handling of Personal Information with such business contractor);
  3. If you provide your consent; or
  4. If it is necessary to disclose or provide Personal Information in order to protect the life, body, or property of the Customer or any third party, and it is difficult to obtain the Customer's consent in advance.

Article 16. Joint use of Personal Information

The Company may use, together with the following joint users, the Personal Information provided by the Customer, together with the following joint users. The items, etc., of the Personal Information that may be jointly used shall be as follows:

    Purposes of use stated in Article 14 "Purposes of use";

  4. Person responsible for managing Personal Information:

Article 17. Management method and retention period

  1. In order to protect the acquired Personal Information from unauthorized access or use, the Company implements appropriate technical and operational security measures. For the measures taken by the Company for security management, please contact the contact desk stated in Article 3.
  2. The Company shall retain the acquired Personal Information to the extent appropriate for providing the Application and Park or for as long as reasonably necessary for the purpose of legal compliance, execution of business, and the Company's legitimate business purposes such as conflict resolution. The actual retention period will vary depending on various factors, such as information type, confidentiality level, business needs, customer expectations and needs, type of available management measures, and form of information retention, etc.
  3. In light of the purposes of use stated in the Privacy Policy, if it is no longer necessary to retain the acquired Personal Information, the Company will destroy or delete such acquired information. The Company will pulverize the acquired Personal Information in the form of paper by turning it into pulp using a grinder, or shall destroy the same by way of incineration; and shall delete the information that is retained in an electronic file format by using such technical method that prevents the records from being restored.

The Application may include links to third-party websites, plug-ins, and apps. Clicking on those links or enabling those connections may allow third parties to collect or share information and data about you. The Company does not control these third-party websites, plug-ins, and apps and is not responsible for their privacy statements. When you leave the Application, the Company encourages you to read the privacy policy of every third party you visit.
